About
The Environmental Improvement Board will consider NMED’s petition to adopt proposed new rule 20.2.51 NMAC. The proposal establishes a state-level methane super-emitter program modeled on the federal program. A super-emitter event would be detected through approved remote sensing technologies and would involve a quantified methane emission rate of at least 50 kg/hr. Qualified entities could apply to NMED for certification as third-party notifiers, submit notifications, and trigger NMED review and notification of owners or operators located within 50 meters of a detected event. Owners or operators would be required to investigate, repair responsible methane leaks, and submit event reports to NMED. The proposal also establishes a zero-methane-emissions standard for process-controller designated facilities, including gathering and boosting stations, natural gas processing plants, tank batteries, transmission compressor stations, and well sites. It specifies exemptions, closed-vent-system design and operating requirements, initial and periodic inspection requirements, and annual reporting of inspections and repairs. The rule is intended to implement the New Mexico Climate Action Plan, address a regulatory gap created by delayed federal methane-super-emitter requirements, accelerate repair of major methane leaks, and reduce emissions from existing oil and gas sources. The hearing is open to the public and allows technical testimony, general public testimony, written comments, and cross-examination.
